Effective Date: July 29, 2026
This Acceptable Use Policy (“AUP”) governs your use of the Fried restaurant-intelligence service (the “Service”) provided by The Fmly Group, LLC d/b/a Fried(“Fried,” “we,” “us,” or “our”). This AUP is incorporated into and forms part of the Fried Terms of Service. Capitalized terms not defined here have the meanings given in the Terms of Service.
By using the Service, you agree not to engage in any of the prohibited activities below.
1. Prohibited Uses
You may not, and may not permit anyone using your account to:
1.1 Unlawful Use
Use the Service for any unlawful purpose, or in violation of any applicable law, regulation, or third-party right.
1.2 Connecting POS Accounts You Do Not Own or Control
Connect, authorize, or attempt to connect any point-of-sale (“POS”) account that you do not own or are not authorized to control. You may only connect locations and accounts for which you have full authority and rights.
1.3 Uploading or Connecting Others' Data Without Rights
Provide to the Service, or connect data sources containing, information that you do not have the right to share — including another business's data or any individual's personal information you are not authorized to process.
1.4 Reselling, Redistribution, and Scraping
Resell, sublicense, rent, or otherwise commercially redistribute the Service or its outputs to third parties; or scrape, crawl, harvest, or use automated means to extract data or content from the Service except through functionality we expressly provide.
1.5 Reverse Engineering
Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, underlying models, or trade secrets of the Service, except to the limited extent applicable law expressly permits despite this restriction.
1.6 Abuse of Rate Limits and Infrastructure
Circumvent or abuse any rate limits, quotas, or technical restrictions; interfere with or disrupt the integrity or performance of the Service; or impose an unreasonable or disproportionately large load on our systems or those of our sub-processors.
1.7 Unauthorized Security Testing
Conduct security testing — including penetration testing, vulnerability scanning, or probing — against the Service without our prior written permission. To report a suspected vulnerability responsibly, contact [email protected].
1.8 Other Harmful Conduct
Introduce malware or harmful code; attempt to gain unauthorized access to any account, system, or data; impersonate any person or entity; or use the Service to harass, defraud, or harm others.
2. Your Responsibility
You are responsible for all activity under your account and for ensuring that anyone you allow to use the Service complies with this AUP and the Terms of Service.
3. Consequences of Violation
If we reasonably believe you have violated this AUP, we may, with or without notice and at our discretion:
- Suspend or restrict your access to the Service, in whole or in part;
- Disconnect any affected POS connection;
- Terminate your account under the Terms of Service; and/or
- Take any other action permitted by law, including reporting unlawful activity to authorities and pursuing available remedies.
Where practical and appropriate, we will aim to give notice and an opportunity to cure, but we may act immediately to protect the Service, our customers, our sub-processors, or third parties.
4. Changes to This Policy
We may update this AUP from time to time. When we make material changes, we will update the “Effective Date” and provide notice through the Service or by email where appropriate. Your continued use of the Service after an update means you accept the revised AUP.
